Section 12142 - Cardroom Business License; Surrender; Abandonment

(a) A cardroom business licensee may propose to surrender their cardroom business license at any time prior to expiration. In order to propose the surrender of a cardroom business license, the cardroom business licensee must submit a written request to the Commission, with a copy to the Bureau. A proposed surrender will be agendized for consideration at the next available Commission meeting. Each proposed surrender will be considered on its merits by the Commission. A proposed surrender is not effective unless and until the surrender is accepted by the Commission. A proposed surrender may be rejected if the Commission determines that acceptance would not be in the public interest, for example, if the cardroom business licensee is currently under investigation or if disciplinary action has been initiated.
(b) A cardroom business license that has been surrendered or abandoned after the effective date of this section is subject to the following:
1. New
section filed 12-12-2002; operative 12-12-2002 pursuant to Government Code
section
11343.4

2. Change without regulatory effect
amending subsection (a) and NOTE filed 6-26-2003 pursuant to section
100, title 1, California Code of
Regulations (Register 2003, No. 26).
3. Change without regulatory
effect amending section filed 6-3-2013 pursuant to section
100, title 1, California Code of
Regulations; operative 7-1-2013 in accordance with Governor's Reorganization
Plan No. 2 of 2012 (Register 2013, No. 23).
4. Relocation and
amendment of article 5 heading from preceding section
12140 to precede section 12142,
repealer of former section 12142 and renumbering of former section
12347 to new section 12142,
including amendment of section heading and section, filed 12-12-2020; operative
1-1-2021 pursuant to Government Code section
11343.4(b)
(Register 2020, No. 51). Filing deadline specified in Government Code section
11349.3(a)
extended 60 calendar days pursuant to Executive Order N-40-20.
