(a) The Department will require random testing of horses exhibited or entered in any public horse show, horse competition, or public horse sale and shall designate the frequency and method of such testing by providing instructions to department personnel, approved California licensed veterinarians, and to laboratories performing analyses.

(b) An owner, trainer, both owner and trainer, or any person designated by the owner or trainer to maintain control of a horse randomly selected for examination by Department personnel shall:

(1) Take the selected horse without delay to a location determined by Department personnel for collection of the sample. Any activity causing delay of sample collection, including, but not limited to, schooling or training, lengthy cooling out period, or bandaging may be considered "non-cooperative."

(2) Remove equipment from the horse.

(3) Remove himself or herself from the immediate proximity of the horse.

(4) Avoid activities distractive to the horse.

1. Amendment filed 3-22-73; effective thirtieth day thereafter (Register 73, No. 12).
2. Repealer of Section 1280.7 and renumbering of Section 1280.8 to Section 1280.7 filed 6-24-81 as an emergency; designated effective 7-1-81. Certificate of Compliance included (Register 81, No. 26).
3. Amendment of section and NOTE filed 12-5-2013 as an emergency; operative 1-1-2014 (Register 2013, No. 49). A Certificate of Compliance must be transmitted to OAL by 6-30-2014 or emergency language will be repealed by operation of law on the following day.
4. Certificate of Compliance as to 12-5-2013 order, including amendment adding inadvertently omitted subsection (a) designator, transmitted to OAL 4-2-2014 and filed 5-14-2014; amendments effective 5-14-2014 pursuant to Government Code section 11343.4(b)(3) (Register 2014, No. 20).
5. Amendment of subsection (a) and NOTE filed 10-22-2015; operative 1-1-2016 (Register 2015, No. 43).
