Section 108 - Minimum Qualifications-County Weights and Measures Inspector

(a) The following are the minimum qualifications for admission to the licensing examination for County Weights and Measures Inspector:

(1) Possession of one or more valid statewide specific category licenses as a County Weights and Measures Inspector or County Agricultural Inspector/Biologist; or

(2) Possession of a Bachelor's degree from an accredited four-year college or equivalent educational course credits from an accredited college with specialization in:
(A) One or more appropriate disciplines in chemical or physical science, physics, mathematics, engineering, or other job-related majors such as law enforcement, commerce or marketing. Registration in an accredited four-year college as a senior majoring in one of these fields will admit applicants to the examination but a certificate will not be issued until graduation; or

(B) Any discipline with a minimum of 30 semester units, or equivalent, in one or any combination of the following disciplines:
1. Chemical Science,

2. Commerce,

3. Engineering,

4. Law Enforcement,

5. Marketing,

6. Mathematics,

7. Physical Science,

8. Physics, and/or

9. Statistics

(3) The educational requirements in subdivision (a)(2)(B) may be satisfied if specialized requirements of the Bachelor's degree include any combination of one or more of these disciplines totaling at least 30 semester units, or equivalent, or may be satisfied through additional college level education, or combination thereof.

(4) Provided that the candidate possesses a minimum of 30 semester units, or equivalent, in one or any combination of disciplines specified in subsection (a)(2)(B), experience in one or more of the following may be substituted for up to two years of college on a year-for-year basis (equivalent to 30 semester units per year):
(A) Enforcement of weights and measures or agricultural laws,

(B) The inspection, maintenance, repair or installation of weighing or measuring instruments or equipment,

(C) Consumer protection or resolution of consumer complaints in a public or private consumer affairs agency,

(D) Law enforcement or investigation work in a federal, state or local jurisdiction, or

(E) Responsible quality or quantity control work in the production of consumer commodities. This experience must have been at a level comparable to that of a county weights and measure inspector or agricultural inspector/biologist.

(b) The scope of the licensing examination may include the following:

(1) Wide knowledge of: weights and measures provisions of the California Business and Professions Code, California Code of Regulations, and related Federal laws and regulations pertaining to the following specific categories for which the candidate elects to qualify:
(A) Weight Verification
1. Weighing Devices

2. Weighmaster and Petroleum Products

(B) Measurement Verification
1. Measuring Devices

2. Electric Measuring Devices

3. Compressed Gases

(C) Transaction and Product Verification
1. Quantity Control of Packaged Commodities

2. Weighmaster and Petroleum Products

(2) General knowledge of: laws, regulations, and functions relating to the office of the County Sealer of Weights and Measures; measuring and weighing devices and standards.

(3) Ability to: interpret and apply the provisions of laws and regulations relating to weights and measures; deal tactfully and effectively with persons contacted on enforcement matters, including investigative and testing procedures; establish and maintain cooperative relations with others; analyze situations accurately and take effective action; speak and write effectively.

(c) Persons holding certificates in all of the former categories of Measuring Devices, Electric Measuring Devices and Compressed Gases shall receive a Measurement Verification license.

(d) Persons holding only one or two of these certificates shall receive a Measurement Verification license limited to the respective subcategory(ies) in which previously certified. Such limited licenses shall remain valid subject to renewal requirements specified in Sections 152 and 153. Persons issued such limited licenses shall be allowed to qualify for the full license by successfully participating in an examination for the unlicensed subcategory(ies) as determined appropriate by the Secretary.

(e) Persons holding certificates for the former categories of Weighing Devices and Weighmaster and Petroleum Products shall be issued a Weight Verification license.

(f) Persons holding only one of these two certificates shall receive a Weight Verification license limited to the respective subcategory in which previously certified. Such limited licenses shall remain valid subject to renewal requirements specified in Sections 152 and 153. Persons issued such limited licenses shall be allowed to qualify for the full license by successfully participating in an examination for the unlicensed subcategory as determined appropriate by the Secretary.

(g) Persons holding certificates for the former categories of Quantity Control of Packaged Commodities and Weighmaster and Petroleum Products shall be issued a Transaction and Product Verification license.

(h) Persons holding only one of these two certificates shall receive a Transaction and Product Verification license limited to the respective subcategory in which previously certified. Such limited licenses shall remain valid subject to renewal requirements specified in Sections 152 and 153. Persons issued such limited licenses shall be allowed to qualify for the full license by successfully participating in an examination for the unlicensed subcategory as determined appropriate by the Secretary.
