The only ground for a protest is that the claim contains a misstatement of a material fact. Material facts are:

(1) The date of construction of the stockpond,

(2) its capacity on January 1, 1975,

(3) the primary purpose for which it was constructed and is used in watering livestock, and

(4) that it was not the subject of water rights litigation between private parties prior to January 1, 1974.
