(a) The Secretary of State may de-certify a certified software vendor if the certified software vendor is out of compliance with this Article and fails to timely resolve any compliance issues.

(b) At least thirty (30) business days prior to de-certification, the Secretary of State will provide written notice to the certified software vendor specifying the reasons for de-certification.

(c) A certified software vendor shall have the opportunity to cure any defects or bugs cited by the Secretary of State as reason for de-certification according to the process described in Section 22706.

(d) A software vendor shall have the opportunity to implement any system changes cited by the Secretary of State as reason for de-certification according to the process described in Section 22705.

(e) The Secretary of State will not unreasonably de-certify the certified software vendor while the certified software vendor works to resolve any issues cited as reasons for de-certification. However, the Secretary of State may de-certify the certified software vendor if the Secretary of State determines that the certified software vendor is not making reasonable progress or if keeping the software vendor certified would interfere with accurate filing.

(f) A certified software vendor whose electronic filing system has been de-certified shall be eligible to re-apply for certification following de-certification utilizing the process described in Section 22703.
