Section 2071.2 - Warning Letters

Upon determining that a probable violation of 49 U.S.C. 60101 et seq., 49 C.F.R. Parts 190, 195, 199, and 40, or California Government Code 51010--et seq., or Title 19 of the California Code of Regulations, or any regulation or order issued thereunder has occurred, the State Fire Marshal, or designee, may issue a written warning notifying the operator of the probable violation and advising the operator to correct it or be subject to potential enforcement action in the future. The operator may submit a response to a warning, but is not required to. An adjudication under this Article to determine whether a violation occurred is not conducted for warnings.
