(a) Institution heads may permit, subject to acceptance by a blood collection agency, incarcerated persons to donate blood for charitable and research purposes or to sell their blood only when needed blood cannot be reasonably and readily obtained from other sources. When a blood sale is authorized, the incarcerated person must receive from the purchaser a payment equal to the current market price for purchases of the same type blood. The facility may impose an additional charge to the purchaser to retrieve the cost of Department resources used in the drawing of the blood. Proceeds of such charges shall be deposited in the Incarcerated Welfare Fund.
