Section 3543 - Public Safety Standards for Minimum Time Between Transmission and Accuracy of Information

The department establishes the following minimum performance standards for a continuous electronic monitoring system to enhance public safety:

(a) On a case-by-case basis, determining the minimum time interval between transmissions of information about the location of the individual supervised person under parole supervision shall be based on the following, which shall include, but not be limited to:

(1) The resources of the department.

(2) The criminal history and case factors of the supervised person under parole supervision.

(3) The safety of the victim of the supervised person under parole supervision.

(4) The most current technology available to the department.

(b) The standard for the accuracy of the information identifying the location of the supervised person under parole supervision shall be based on the following, which shall include, but not be limited to:

(1) The need to identify the location of the supervised person proximate to the location of the supervised person's residence or location of a crime.

(2) Resources of the department.

(3) The need to avoid false indications of continuous electronic monitoring violations.
