Section 18986.3 - Waivers for Non-Local Entities and Local Education Agencies

(a) The Department shall waive a non-local entity's or local education agency's obligation to comply with some or all of organic waste collection service requirements of this article if the entity or agency provides documentation demonstrating that any of the following apply:
(1) The total solid waste collection service subscribed to is two cubic yards or more per week and organic waste subject to collection in a blue container or a green container as specified in Section 18984.1(a) comprises less than 20 gallons per week per applicable container of the non-local entity's or local education agency's total waste.
(2) The total solid waste collection service subscribed to is less than two cubic yards per week and organic waste subject to collection in a blue container or a green container as specified in Section 18984.1(a) comprises less than 10 gallons per week per applicable container of the non-local entity's or local education agency's total waste.
(3) A hauler, licensed architect, or licensed engineer has determined that there is not adequate space for separate organic waste containers.
(4) The entity is located within a jurisdiction or census tract that has been granted a waiver by the Department pursuant to Section 18984.12.
