Section 1760.1 - Definitions

(a) The following definitions are applicable to this subchapter:

(1) "Aquifer" means a geological formation, group of formations, or part of a formation that is capable of yielding a significant amount of water to a well or spring.

(2) "Aquifer exemption" means an aquifer exemption proposed by the Division and approved pursuant to the Code of Federal Regulations, title 40, section 144.7.

(3) "Hydrocarbon producing zone" means the portion of an aquifer that is hydrocarbon producing, or can be demonstrated to the Division's satisfaction to contain hydrocarbons that considering their quantity and location are expected to be commercially producible.

(4) "TDS" means milligrams per liter of total dissolved solids content.

1. New section filed 4-20-2015 as an emergency; operative 4-20-2015 (Register 2015, No. 17). A Certificate of Compliance must be transmitted to OAL by 10-19-2015 or emergency language will be repealed by operation of law on the following day.
2. New section refiled 10-19-2015 as an emergency; operative 10-20-2015 (Register 2015, No. 43). A Certificate of Compliance must be transmitted to OAL by 1-19-2016 or emergency language will be repealed by operation of law on the following day.
3. New section refiled 1-21-2016 as an emergency; operative 1-21-2016 (Register 2016, No. 4). A Certificate of Compliance must be transmitted to OAL by 4-20-2016 or emergency language will be repealed by operation of law on the following day.
4. Certificate of Compliance as to 1-21-2016 order transmitted to OAL 3-8-2016 and filed 4-20-2016 (Register 2016, No. 17).
