(a) Subchapter 2 shall serve as the minimum Wildfire protection standards applied in SRA and VHFHSZ. However, Subchapter 2 does not supersede local regulations which equal or exceed the standards of this Subchapter.

(b) A local regulation equals or exceeds a minimum standard of this Subchapter only if, at a minimum, the local regulation also fully complies with the corresponding minimum standard in this Subchapter.

(c) A Local Jurisdiction shall not apply exemptions to Subchapter 2 that are not enumerated in Subchapter 2. Exceptions requested and approved in conformance with § 1270.07 (Exceptions to Standards) may be granted on a case-by-case basis.

(d) Notwithstanding a local regulation that equals or exceeds the State Minimum Fire Safe Regulations, Building construction shall comply with the State Minimum Fire Safe Regulations.

1. New section filed 5-30-91; operative 5-30-91 pursuant to Government Code section 11346.2(d) (Register 91, No. 27).
2. Amendment of subsection (a)(3), new subsections (a)(4) and (b), subsection relettering and amendment of newly designated subsection (c) and NOTE filed 1-31-2013; operative 4-1-2013 (Register 2013, No. 5).
3. Amendment of section heading and section filed 9-6-2019; operative 1-1-2020 (Register 2019, No. 36).
4. Repealer of subsections (b)-(b)(2) and subsection relettering filed 7-27-2020 as an emergency; operative 7-27-2020 (Register 2020, No. 31). A Certificate of Compliance must be transmitted to OAL by 1-25-2021 or emergency language will be repealed by operation of law on the following day.
5. Emergency filed 7-27-2020 extended an additional 60 days (Executive Order N-40-20). A Certificate of Compliance must be transmitted to OAL by 3-26-2021 or emergency language will be repealed by operation of law on the following day.
6. Emergency filed 7-27-2020 extended an additional 60 days pursuant to Executive Order N-66-20 (Register 2020, No. 38). A Certificate of Compliance must be transmitted to OAL by 5-25-2021 or emergency language will be repealed by operation of law on the following day.
7. Repealer of subsections (b)-(b)(2) and subsection relettering refiled 5-10-2021 as an emergency; operative 5-10-2021 (Register 2021, No. 20). Emergency expiration extended 60 days (Executive Order N-40-20) plus an additional 60 days (Executive Order N-71-20). A Certificate of Compliance must be transmitted to OAL by 12-7-2021 or emergency language will be repealed by operation of law on the following day.
8. Repealer of subsections (b)-(b)(2) and subsection relettering refiled 12-6-2021 as an emergency; operative 12-6-2021 (Register 2021, No. 50). A Certificate of Compliance must be transmitted to OAL by 3-7-2022 or emergency language will be repealed by operation of law on the following day.
9. Reinstatement of section as it existed prior to 7-27-2020 amendment by operation of Government Code section 11346.1(f) (Register 2022, No. 15).
10. Renumbering of former section 1270.05 to section 1270.06 and renumbering of former section 1270.04 to section 1270.05, including amendment of section, filed 1-31-2023; operative 4-1-2023 (Register 2023, No. 5). Transmission deadline specified in Government Code section 11346.4(b) extended 60 calendar days pursuant to Executive Order N-40-20 and an additional 60 calendar days pursuant to Executive Order N-71-20. Filing deadline specified in Government Code section 11349.3(a) extended 60 calendar days pursuant to Executive Order N-40-20 and an additional 60 calendar days pursuant to Executive Order N-71-20.
