Section 1270.02 - Purpose

(a) Subchapter 2 has been prepared and adopted for the purpose of establishing state minimum Wildfire protection standards in conjunction with Building, construction, and Development in the State Responsibility Area (SRA) and, after July 1, 2021, the Very High Fire Hazard Severity Zones, as defined in Government Code § 51177(i) (VHFHSZ).

(b) The future design and construction of Structures, subdivisions and Developments in the SRA and, after July 1, 2021, the VHFHSZ shall provide for basic emergency access and perimeter Wildfire protection measures as specified in the following articles.

(c) These standards shall provide for emergency access; signing and Building numbering; private water supply reserves for emergency fire use; vegetation modification, Fuel Breaks, Greenbelts, and measures to preserve Undeveloped Ridgelines. Subchapter 2 specifies the minimums for such measures.

3. Amendment filed 9-6-2019; operative 1-1-2020 (Register 2019, No. 36).
4. Amendment filed 7-27-2020 as an emergency; operative 7-27-2020 (Register 2020, No. 31). A Certificate of Compliance must be transmitted to OAL by 1-25-2021 or emergency language will be repealed by operation of law on the following day.
5. Emergency filed 7-27-2020 extended an additional 60 days (Executive Order N-40-20). A Certificate of Compliance must be transmitted to OAL by 3-26-2021 or emergency language will be repealed by operation of law on the following day.
6. Emergency filed 7-27-2020 extended an additional 60 days pursuant to Executive Order N-66-20 (Register 2020, No. 38). A Certificate of Compliance must be transmitted to OAL by 5-25-2021 or emergency language will be repealed by operation of law on the following day.
7. Change without regulatory effect amending subsection (a)(1) filed 2-1-2021 pursuant to section 100, title 1, California Code of Regulations (Register 2021, No. 6).
8. Amendment refiled 5-10-2021 as an emergency; operative 5-10-2021 (Register 2021, No. 20). Emergency expiration extended 60 days (Executive Order N-40-20) plus an additional 60 days (Executive Order N-71-20). A Certificate of Compliance must be transmitted to OAL by 12-7-2021 or emergency language will be repealed by operation of law on the following day.
9. Amendment refiled 12-6-2021 as an emergency; operative 12-6-2021 (Register 2021, No. 50). A Certificate of Compliance must be transmitted to OAL by 3-7-2022 or emergency language will be repealed by operation of law on the following day.
10. Reinstatement of section as it existed prior to 7-27-2020 amendment by operation of Government Code section 11346.1(f) (Register 2022, No. 15).
11. Editorial correction reinstating language in subsection (a)(1) from 2-1-2021 nonsubstantive action (Register 2022, No. 18).
12. Repealer and new section filed 1-31-2023; operative 4-1-2023 (Register 2023, No. 5). Transmission deadline specified in Government Code section 11346.4(b) extended 60 calendar days pursuant to Executive Order N-40-20 and an additional 60 calendar days pursuant to Executive Order N-71-20. Filing deadline specified in Government Code section 11349.3(a) extended 60 calendar days pursuant to Executive Order N-40-20 and an additional 60 calendar days pursuant to Executive Order N-71-20.
