Section 2139.5 - Carb Authority to Test for Heavy-Duty in-Use Compliance

The CARB Executive Officer is authorized to conduct Heavy Duty In-Use Compliance (HDIUC) testing using the appropriate procedures in 40 CFR § 86.1370, as amended October 25, 2016 and 40 CFR Part 86 Subpart T, as amended October 25, 2016, that are incorporated by reference in the "California Exhaust Emission Standards and Test Procedures for 2004 and Subsequent Model Heavy-Duty Diesel Engines and Vehicles," incorporated by reference in title 13, California Code of Regulations, section 1956.8(b) and "California Exhaust Emission Standards and Test Procedures for 2004 and Subsequent Model Heavy-Duty Otto-Cycle Engines and Vehicles," incorporated by reference in title 13, California Code of Regulations, section 1956.8(d), to identify engines that fail to conform to the applicable emission standards in title 13, California Code of Regulations, section 1956.8, and to take corrective action against the manufacturers of such vehicles and engines based on the results of this testing.

Transmission deadline specified in Government Code section 11346.4(b) extended 60 calendar days pursuant to Executive Order N-40-20. Filing deadline specified in Government Code section 11349.3(a) extended 60 calendar days pursuant to Executive Order N-40-20 and an additional 60 calendar days pursuant to Executive Order N-71-20.
