Section 2112 - Same; When Required of Employee

Every employee or salesperson of a licensed dealer or dealer's subsidiary shall be licensed to transact insurance unless

(a) The employee or salesperson is a regularly salaried administrative or clerical employee who devotes substantially all of the employee's or salesperson's services to activities other than the solicitation of insurance from the insuring public and receives no commission on insurance, directly or indirectly, or

(b) The employee or salesperson devotes substantially all of the employee's or salesperson's activities to selling merchandise and the employee's or salesperson's solicitation of insurance is limited only to the quoting of a premium for insurance, to be included in the purchase price, covering the interest retained in such merchandise by the dealer, and the employee or salesperson receives no commission on insurance, directly or indirectly.

2. Change without regulatory effect amending section filed 7-14-2021 pursuant to section 100, title 1, California Code of Regulations (Register 2021, No. 29). Filing deadline specified in Government Code section 11349.3(a) extended 60 calendar days pursuant to Executive Order N-40-20.
