AR 8.2 PRISON ALTERNATIVE TRANSITIONAL HOUSING (PATH)
I.
AUTHORITY. The Board of Corrections (BOC) is vested with the
authority to promulgate this administrative regulation by Ark. Code Ann.
§§
12-27-105,
16-93-1203,
16-93-1205
and
16-93-1603.
II.
APPLICABILITY. This policy
applies to Department of Community Correction (DCC) and Department of
Correction (DOC) employees and eligible offenders in their custody or under
their supervision.
III.
POLICY. It is BOC policy that DCC and DOC work collaboratively to
assist in the placement/reentry of eligible offenders, following prison
incarceration/confinement, to allow participation in DCC Prison Alternative
Transitional Housing (PATH) to ensure a positive and safe environment for
clients and for public safety, with the goal of reducing recidivism.
IV.
CRITERIA FOR PATH HOUSING.
Residency in PATH is voluntary. Applicants approved for transfer from a DOC or
DCC facility to PATH must have made parole or transfer status and are being
held in prison due to the lack of suitable housing.
V.
PATH DESCRIPTION.
A. PATH provides a chemical, tobacco,
alcohol, and drug-free housing environment for offenders who lack suitable
housing and who have been approved by the Parole Board for release from DOC and
DCC correctional facilities.
B.
PATH tenants have the obligation of paying rent and handling responsibilities.
Failure to pay rent subjects the tenant to removal from the housing.
C. PATH oversight, supervision and case
management will be provided by a Parole/Probation Officer exclusively assigned.
DCC Community Correction Center (CCC) monitoring will be conducted by P/P or
CCC staff.
D. Visitation from
non-tenants is not allowed at the PATH facility.
E. Tenants must maintain or be seeking
employment or in school.
F. Except
when carried by law enforcement officers, firearms and other weapons are not
allowed on the PATH premises.
G.
The PATH drug and alcohol-free environment will be enforced.
H. Tenants are allowed to have vehicles, and
parking is provided, subject to license and appropriate insurance
coverage.
VI.
APPLICATION AND RULES. An application and rules concerning living
activity and provisions must be developed and posted in areas accessible to the
tenants. The rules will address DCC services, responsibilities, meals, laundry,
medical, legal, telephone, transportation, housekeeping, grounds, compliance,
security, and others. PATH tenants must sign and adhere to rules established
for the facility.
