Rule 138.00.77-001 - Amendments to Rules Governing the Arkansas Dam Safety Program

AMENDMENTS TO RULES GOVERNING THE ARKANSAS DAM SAFETY PROGRAM

The following rules were promulgated by the Arkansas Soil and Hater Conservation Commission, established by Act 14 of 1963, in accordance with Act 81 of 1957 and in compliance with Act 434 of 1967.

1. Any and all plans and specifications which are submitted to the Commission in accordance with Section 6(B) of Act 81 of 1957 shall have been developed by or under the direct supervision of a registered professional engineer in the State of Arkansas or an agent of the United States Department of Agriculture, Soil Conservation Service.

2. In accordance with Section 6(A) of Act 81 of 1957, from and after the effective date of these amended rules, the supervision of all work by the contractor shall be accomplished by a competent representative of the design engineer,

In accordance with Section 6(A) 2 of Act 81 of 1957, from and after the effective date of these amended rules, the Commission or its representative shall conduct two or more inspections of the work during construction-one inspection being the final inspection prior to the structure impounding water.

4. That within thirty (30) days after the completion of the construction, the owner shall file with the Commission a statement certifying that the work was performed 1n accordance with the approved plans and specifications and these rules. At which time, the Commission will declare the structure ready for operations.
