STATE PLAN UNDER TITLE XIX OF THE SOCIAL SECURITY ACT

State/Territory: ARKANSAS

CATEGORICAL DETERMINATIONS

Arkansas applies categorical determinations that admission to or residence in a NF is normally needed to individuals who are:

1. terminally ill, comatose, ventilator dependent, or severely ill and whose impairment is so severe that the individual could not be expected to benefit from specialized services; or,

2. admitted from a hospital for convalescent care due to an acute physical illness, for a period not to exceed 90 days, and who are not a danger to self or others.

Arkansas applies categorical determinations that specialized services are not needed to individuals with mental retardation, or a related condition, and a concurrent diagnosis of dementia.
