Sec. 185

1. No motor in excess of 10 H.P. will be permitted.

(Exceptions! Party Barges may use up to and including 25 H.P. and authorized Commercial Boat Docks will be required to have an emergency boat with sufficient horsepower to answer any emergency that might arise/ regardless of lake conditions.)

2. Catamaran or "Party Barge" shall not exceed 8* x 22' in size.

3. Boat Houses (not to include sleeping or toilet facilities or living quarters) for private riparian landowners and/or cabin owners, may be constructed if written permission has been granted by the Arkansas Game and Fish Commission. The Permit for a Single Boat House is $5.00.

4. Such structure shall not exceed 24 feet in length and 14 feet in width, nor shall it have a walkway longer than 6 feet from shoreline to boat House construction.

5. If two (2) riparian landowners and/or cabin owners desire to build a Joint Boat House, such structure shall not exceed 24 feet in length and 24 feet in width, and walkway from shoreline to Boat House shall not exceed 6 feet in length, and no other Boat House will be permitted a riparian land and/or cabin owner when having joint ownership in such a dual Boat House as described herein. The Permit for construction of a jointly-owned Boat House shall be $10.00.

6. Boat Docks or Piers (platform type) (not to include living i quarters) for private riparian landowners and/or cabin owners may be constructed if written permission has been granted by the Arkansas Game and Fish Commission, said Dock or Pier shall not exceed 6' x 100' and the Permit shall be $5.00. Boat Docks or Piers must be open to the public and cannot be for the exclusive use of the owner.

7. All structures must be approved as to the design, dimensions and materials by the Arkansas Game and Fish Commission, and' shall be permanently fixed adjacent to the owners1 lot or land.

8. Boat Docks, Piers or Houses must display the Arkansas Game and Fish Commission Permit Number. Permit Numbers must be a minimum of 3" in height and placed on the side of the structure facing the center of the lake. Permits Are Not Transferable. In the event the adjacent land and approved structure is sold, the buyer must procure from the Arkansas Game and Fish Commission an additional $5.00 or $10.00 Permit in his name.

9. The riparian landowner must remove the construction when he no longer has need for it or pay for the removal of the construction. Such construction shall be maintained in good repair and maintenance at all times. Failure of construction to pass inspection by the Arkansas Game and Fish Commission will be grounds for revoking a Permit.

10. Permits must be inspected and Renewed with a $5.00 or $10.00 fee each Five (5) Years from issuance of said Permit.

11. A riparian landowner and/or cabin owner shall assume all personal and property liability in conjunction with a structure on which a Permit has been issued.

12. A written agreement shall be signed by the riparian landowner and/or cabin owner agreeing to the terms of this Commission Order on any structure or other special activity upon the waters of the lake and upon the Commission property circumventing the lake.

13. The Commission property circumventing the lake cannot be fenced or otherwise be blocked to prohibit the public free access to the lake.

14. No change in the configuration of the shoreline will be allowed without special permission of the Commission. A separate permit will be negotiated with the Commission in advance of each desired change.

15. All structures which were in place prior to the enactment of this regulation (July 1, 1963) and as amended (May 19, 1969, and September 15, 1969), and which do not conform to these regulations may be left in place until such time as any repairs are needed. Then a new permit must be negotiated adhering to the above regulations.

PENALTY: Any person violating any of the provisions of this Section shall be guilty of a misdemeanor and, upon conviction, shall be fined in any sum not less than ten dollars ($10.00) nor more than two hundred and fifty dollars ($250.00).

ORDER

It shall be unlawful to hunt deer in those portions of the state designated as Zone 23. Zone 23 includes that part of Baxter County bounded on the south by Hwy. 178, on the west and north by Bull Shoals Lake, and on the east by the Central Electric Power Corp- Transmission line from Howard Creek south to Hwy. 178; that part of Baxter County known as Bidwell Point along Hwy. 101, bounded by Lake Norfork on the east, south, and west, and by the old Arkansas-Missouri highway from the state line to Bennett's Bayou; that part of Marion County known as the Bull Shoals Peninsula, bounded on the east and north by White River and Lake Bull Shoals, on the west by the Jimmie Creek arm of Lake Bull Shoals, and on the south by the county roads running east and west from Fairview community; that part of Benton County bounded on the north by Beaver Lake, on the east by Beaver Lake and Van Hollow Creek, and on the south and west by Hwy. 12 from Van Hollow Creek westward to Beaver Lake; that part of Carroll and Benton County bounded on the north by Hwy. 62, on the east by Hwy. 187 and Henry Hollow Creek and the south and west by Beaver Lake and the road from Beaver Dam north to Hwy. 62; that part of Conway County lying above the Rimrock on Petit Jean Mountain.

This order will expire as of June 30, 1971.
