41.05(B) RESIDENT ROE BUYER/EXPORTER AND NON-RESIDENT ROE BUYER/EXPORTER PERMIT REQUIREMENTS.

It shall be unlawful to buy or export across the state line paddlefish or sturgeon, or their parts, including eggs (roe), without first obtaining a current Resident Roe Buyer/Exporter Permit or Non-Resident Buyer/Exporter Permit, as applicable. Licensed commercial fishermen who hold current Resident Roe Buyer/Exporter Permit may also take paddlefish and sturgeon in accordance with applicable season, size and tackle regulations.

EXCEPTIONS:

(1) Sportsmen in compliance with Code 31.01B, Game Fish Possession Limit Restrictions.

(2) Permitted fish farmers in compliance with Code 42.10, Paddlefish, Sturgeon and Bowfin Roe Regulations.

(3) Paddlefish and sturgeon flesh (meat) only may be purchased from permitted Roe Taker/Sellers and Roe Buyer/Exporters in compliance with Code 41.06.

(4) Paddlefish/sturgeon flesh and/or roe can be transported by an authorized representative of a legally permitted Resident Buyer/Exporter if accompanied by a true bill of lading or bill of sale indicating name and permit number of the authorizing Resident Buyer/Exporter and including the species, number of pounds of roe or flesh per species, and if being sold, the name of the purchaser. A true bill of lading or bill of sale must accompany the shipment to the final destination.

(5) Paddlefish, sturgeon, or their flesh (excluding eggs or roe) may be purchased for personal use without purchasing either a Resident/Non-Resident Roe Buyer/Exporter permit in compliance with Code 41.06.

(6) Licensed Resident Roe Buyer/Exporter only may purchase up to two Resident Roe Buyer/Exporter Agent Permits. Agents can purchase only for their licensed buyer/exporter. Unless in the presence of their Resident Roe Buyer/Exporter, Resident Roe Buyer/Exporter Agents are solely responsible for compliance with regulations applying to roe purchases.

PENALTY: $500.00 to $1,000.00 and fishing privileges may be suspended in accordance with Code 11.05, Revocation of Privileges.

Resident Roe Buyer/Exporter Agent Permit

Background Information

Currently, a Roe Buyer/Exporter Permit is required for an individual to purchase roe (generally paddlefish, sturgeon, bowfin) from a Roe Taker. There are less than 5 Roe Buyer/Exporters in Arkansas. One of these has requested that we allow designated agents of the Roe Buyer/Exporter to purchase roe for the Roe Buyer/Exporter. This will be a cost-savings and a convenience for the Roe Buyer/Exporters. They will have the option to purchase roe when they are unavailable themselves and at more than one location.

At this time, we are recommending that both the Resident Roe Buyer/Exporter and Resident Roe Buyer/Exporter Agent be held responsible for any violations that the Resident Roe Buyer/Exporter Agent may commit. We are also recommending that the Resident Roe Buyer/Exporter Agent Permit should cost $100.

Justifications for Regulation Change

* It will afford potential cost-savings for Resident Roe Buyer/Exporters

* It will allow the Resident Roe Buyer/Exporter more opportunities to purchase roe which will also benefit Roe Takers

* Both the Resident Roe Buyer/Exporter and the Agents will be held responsible for their own actions and complying with regulations (both state and federal) regarding roe purchases

* The $100 fee for the Resident Roe Buyer/Exporter Agent Permit will offset agency handling costs and promote the selection of quality agents

* The change is not expected to have an effect of populations of roe-producing fish.
