Rule 002.00.02-010 - Approved Aquaculture Species Policy; Changes to Commercial Fishing Regulations for 2002; Prohibition of Wildlife Commercial Breeder / Dealer Permits for Deer, Elk and Other Cervids for New Facilities

32.12 THE RELEASE OF NATIVE OR NON-NATIVE AQUATIC WILDLIFE PROHIBITED It shall be unlawful to release any native or non-native aquatic wildlife, including their eggs, into the public waters of the State of Arkansas without the written permission of the Chief of Fisheries, Arkansas Game and Fish Commission. Excess baitfish (including crayfish) shall not be released alive into public waters. Any request for importation of salmonids and salmonid eggs must be accompanied by an official disease free certification conducted under the guidelines set forth by the American Fisheries Society Fish Health Blue Book - Procedures for the Detection and Identification of Certain Fish Pathogens, Fourth Edition.

EXCEPTION:

32.14 COTTON LINE ANCHORING REQUIREMENTS All trotlines, snaglines, throwlines, limblines, and set hooks shall be tied-off or anchored at both ends with 100% cotton line only.

EXCEPTION:

32.15 THE USE OR SALE AS BAITFISH OF GRASS CARP, SILVER CARP, BLACK CARP, BIGHEAD CARP, OR EUROPEAN RUDD PROHIBITED

It shall be unlawful to use or offer for sale as baitfish Grass Carp, Silver Carp, Black Carp, Bighead Carp, or European Rudd to vendors and anglers within the State.

PENALTY: $100.00 to $1,000.00.

32.16 TRANSPORTATION OF ZEBRA MUSSELS PROHIBITED It shall be unlawful to knowingly transport zebra mussels into or between the waters of the State of Arkansas.

PENALTY: $100.00 to $1,000.00.

32.17 RESTRICTIONS FOR TAKING SUCKERS.

32.XX PERMIT REQUIRED TO POSSESS SILVER CARP, BIGHEAD CARP, DIPLOID BLACK CARP, OR EUROPEAN RUDD. It shall be unlawful to possess live silver carp, bighead carp, diploid black carp, or European rudd without obtaining a current Restricted Species Possession Permit for said species.

PENALTY: $100.00 to $1,000.00.

42.00-A AQUACULTURE SPECIES DEFINED. Aquaculture Species shall mean any species listed on the Approved Aquaculture Species List (available from Fisheries Division) and species not listed but allowed under Unlisted or Restricted Species Possession Permits.

42.00-AB FISH FARMER (AQUACULTURIST) DEFINED. A Fish Farmer (Aquaculturist) shall mean any person, firm, or corporation engaged in the propagation or production of Aquaculture Species on property owned or controlled by said farmer.

42.01 FISH FARMER (AQUACULTURIST) PERMIT REQUIREMENTS. It shall be unlawful for fish farmers to culture and/or sell Aquaculture Species without first obtaining a Fish Farmers (Aquaculturist) Permit annually. A Fish Dealer License is required to sell minnows retail unless sold on property where minnows are grown.

PENALTY: $100.00 to $1,000.00.

42.02 FISH FARMER (AQUACULTURIST) SALES RECORDS REQUIREMENTS. It shall be unlawful for fish farmers (Aquaculturists) to fail to maintain legible records indicating sales and shipments and to reveal said records to a Commission Officer for inspection upon request.

PENALTY: $100.00 to $1,000.00.

42.03 FISH FARMER (AQUACULTURIST) BILL OF LADING REQUIREMENTS. It 10-99 shall be unlawful for fish farmers (Aquaculturists) to fail to furnish bill of lading or bill of sale as specified herein:

42.04 FISH FARMER (AQUACULTURIST) TACKLE REQUIREMENTS. It shall be unlawful for fish fanners (Aquaculturists) to use or transport illegal commercial tackle without first complying with Commission Code 42.01 (Fish Farmer (Aquaculturist) Permit Requirements).

PENALTY: $100.00 to $1,000.00.

42.09 REARING OR SALE OF RESTRICTED AND UNLISTED AQUACULTURE SPECIES PROHIBITED.

It shall be unlawful to engage in the rearing or sale of aquatic species not listed on the Approved Aquaculture Species List (list available from Fisheries Division) without first applying for and obtaining a Restricted Species Possession Permit (Restricted Species List available from the Fisheries Division) or an Unlisted Aquaculture Species Permit from the Chief of Fisheries.

EXCEPTION:

41.05(A) RESIDENT ROE TAKER/SELLER PERMIT REQUIREMENTS It shall be unlawful to take, sell or possess paddlefish (also called spoonbill catfish)- or sturgeon or their parts, including eggs (roe), without first obtaining a current Resident Roe Taker/Seller Permit. A commercial fishing license is required to purchase a Resident Roe Taker/Seller Permit.

EXCEPTION:

41.05(B) RESIDENT ROE BUYER/EXPORTER AND NON-RESIDENT ROE BUYER/EXPORTER PERMIT REQUIREMENTS. It shall be unlawful to buy or export across the stateline paddlefish or sturgeon or their parts, including eggs (roe), without first obtaining a current Resident Roe Buyer/Exporter Permit or Non-Resident Buyer/Exporter Permit, as applicable. Licensed commercial fishermen who hold current Resident Roe Buyer/Exporter Permit may also take paddlefish and sturgeon in accordance with applicable season, size and tackle regulations.

EXCEPTION:

41.12 UNDERSIZED COMMERCIAL FISH PROHIBITED. It shall be unlawful for commercial fishermen to possess catfish or buffalo fish less than 16 inches in length or paddlefish, sturgeon and bowfin of any size taken from public waters.

EXCEPTION:

41.30 PADDLEFISH AND STURGEON POSSESSION RESTRICTIONS ON WHITE RIVER, ARKANSAS RIVER AND BORDER WATERS It shall be unlawful to commercially take or possess paddlefish (also called spoonbill catfish) or sturgeon or their parts, including eggs (roe), from:

41.39 PADDLEFISH AND STURGEON HARVEST RESTRICTIONS It shall be unlawful to take from public waters or possess paddlefish (also called spoonbill catfish) or sturgeon or their parts, including eggs (roe), during the period of Noon, April 15 to Noon, November 15.

EXCEPTION:

41.XX CUTTING OR MUTILATION OF PADDLEFISH AND STURGEON PROHIBITED. It shall be unlawful to cut or mutilate paddlefish or sturgeon and release the fish back to the wild. A 12-gauge needle may be used to determine the presence of eggs. Eggs may not be removed from harvested fish while on the water unless a minimum 2-inch portion of each ovary remains attached in each fish. Eggs must be kept in separate containers, one fish only per container.

PENALTY: $500.00 to $1000.00 and fishing privileges may be suspended in accordance with Code 11.05, Revocation of Privileges.

41.39 Closed Paddlefish, Sturgeon and Bowfin Harvest Season.

Upon conviction of the offender, the court having jurisdiction may order title to the equipment forfeited to the Arkansas Game and Fish Commission and such equipment disposed of in accordance with Commission policy. Equipment confiscated may be advertised and sold at public auction with the proceeds of the sale to be deposited in the Game Protection Fund.

02.12 GAME ANIMAL DAILY BAG LIMIT AND POSSESSION RESTRICTIONS. It shall be unlawful to take or attempt to take more than the bag limit of any game species set forth by the Commission as specified herein: (Ref: Section 01.00-C Bag Limit).

Spring Turkey Zone 1A - Northwest Arkansas. 23.02 SPRING TURKEY SEASON RESTRICTIONS ON CERTAIN WMAS. It shall be unlawful to take or attempt to take turkeys during the spring turkey season on the following WMA's other than as specified herein:

QUOTA PERMIT HUNTS: Permit required. Only permit holders will be allowed to engage in any hunting-related activities on areas where a permit is required during quota permit hunts. Limit - one (1) legal turkey. Turkeys must be checked at designated check stations. Other specific regulations are listed below:

PRE-SEASON SPECIAL YOUTH PERMIT HUNTS: Special youth hunts will be held on the Wildlife Management Areas specified herein on March 29-30, 2003. Youths (under 16 as of 05-12-2003 ) only; must be accompanied by one unarmed adult. Youths must have successfully completed a hunter education course. Permit required for both youth and adult (Ref. Code 04.08). Only youth and an accompanying adult with appropriate permits will be allowed to engage in any activity other than those related to fishing on the following WMAs during the special youth permit hunts. Limit - one legal turkey. Turkey must be checked at designated check station(s).
