01.00-C DEFINITION OF TERMS. For the purposes of the Arkansas Game and Fish Commission Code of Regulations, the following terms shall be construed, respectively, to mean and include:

GUIDE - Any person who provides, for monetary or any other compensation, that person's personal services for the purpose of assisting others to locate, pursue, catch or hunt wildlife.

01.00-J POINT SYSTEM FOR HUNTING AND/OR FISHING VIOLATIONS. The accumulation of 12 points for hunting and/or fishing violations within a three year period shall result in the individual being ineligible to apply for any Commission deer, turkey and elk permit hunts for the duration of the three-year period. The accumulation of 18 points for hunting and/or fishing violations within a three-year period may result in the revocation of all hunting and/or fishing licenses and the privileges attached thereto for one year, and the accumulation of 30 points within a five year period may result in the loss of all licenses and privileges for three years. A revocation of hunting and/or fishing licenses and privileges occurring for a third time during an individual's lifetime may result in the lifetime revocation of all hunting and/or fishing licenses and privileges. Any person who forfeits bond, pleads guilty or nolo contendere, or is found guilty of violating any hunting or fishing regulation shall be assigned points as follows:

** 18.03 Selling Wildlife Restrictions. A conviction for violating this regulation may result in the lifetime revocation of all hunting and/or fishing licenses.

The following violations shall result in a double assessment of the respective point value for the violation committed upon final court disposition:

1) Any violation occurring on a Commission-owned Wildlife Management Area (except boating statutes).

2) Any violation of harvest regulations committed by a Guide License holder.

3) Any violation of trout harvest regulations in a trout catch and release area.

4) Any violation of bass harvest regulations on lakes designated as Trophy Bass Management Areas (Lakes Monticello, Lower White Oak, Columbia, SWEPCO, Pickthome and Austelle).

5) Adults 21 years or older when accompanying youth under 16.

11.08 HUNTING, FISHING, OR TRAPPING WITHOUT LANDOWNER/LESSEE PERMISSION PROHIBITED.

(A) It shall be unlawful for any person to hunt, fish, or trap wildlife upon the private property of another without having first obtained permission from a landowner or lessee of the property.

(B) Notwithstanding the provisions of subsection (A), it shall be unlawful for any person to hunt, fish, or trap wildlife upon the private property of another without carrying written permission from a landowner or lessee of the property if the property is lawfully posted or fenced in accordance with one of the methods provided in Arkansas Codes 18-11-404 or 18-11-405. The written permission must include the name of the person permitted upon the property, the signature and telephone number of the landowner or lessee, and the beginning and ending dates of the permission period.

EXCEPTION:

Written permission shall not be required under subsection (B) if the person hunting, fishing or trapping wildlife is the spouse, mother, father, son, daughter, brother, sister, uncle, aunt, son-in-law, daughter-in-law, niece, nephew, grandson, granddaughter, grandmother, or grandfather of the landowner or lessee of the private property, and has actual permission of the landowner or lessee.

PENALTY: $100.00 to $1,000.00.

12.20 CANADA GOOSE SEASON RESTRICTIONS. It shall be unlawful to take or attempt to take Canada geese other than from January 9-31, 2002, from one-half hour before sunrise to sunset statewide. Areas closed to Canada goose hunting within the state are: Holla Bend National Wildlife Refuge Migratory Bird Closure Zone, and all parks (except Lead Hill Park on Bull Shoals Lake administered by the Corps of Engineers).

PENALTY: $200.00 to $1,000.00.

13.07 NONTOXIC SHOT REQUIREMENTS FOR WATERFOWL HUNTING. It shall be unlawful to possess while waterfowl hunting any shot other than steel, tungsten-iron, tungsten-polymer, tungsten matrix, tiner bismuth-tin or such shot approved as nontoxic by the U.S. Fish and Wildlife Service pursuant to Part 20 of Title 50 of the Code of Federal Regulations.

PENALTY: $100.00-$1000.00

15.04 WILDLIFE COMMERCIAL HUNTING RESORT PERMIT.

(A) It shall be unlawful for a person to operate or maintain a wildlife commercial hunting resort without annually first obtaining a Wildlife Commercial Hunting Resort Permit.

(B) Native game (except black bear) may be hunted in accordance with statewide hunting regulations in enclosures equal to or greater than 500 contiguous acres of free range, having a fence of not less than eight (8) feet in height with no cross fencing that has the effect of reducing the size of the area to less than 500 contiguous acres, and having a minimum of sixty percent (60%) of forested cover that has been classified as timberland by the local county tax assessor provided the owner registers the enclosure with the Commission sixty days prior to initiation of hunting, or upon any change of ownership or enclosure size.

(C) Hunting of non-native game is prohibited.

EXCEPTIONS:

(1) Elk may be hunted within high fenced enclosures during open deer seasons in that zone using hunting equipment legal for that season.

(2) Deer and elk may be hunted with any weapon legal for deer or elk hunting within high fence enclosures from October 1 through February (Ref. Commission Code 02.01).

PENALTY: $500.00 to $1000.00.

18.18 WATERFOWL HUNTING RESTRICTIONS ON LAKES CATHERINE, HAMILTON AND HARRIS BRAKE. It shall be unlawful to take or attempt to take any migratory waterfowl from any watercraft or other floating device on Lake Catherine in Garland/Hot Spring Counties, Lake Hamilton in Garland County, and Harris Brake Lake in Perry County

PENALTY: $100.00 to $1,000.00.

18.26 HUNTING NEAR A RESIDENCE PROHIBITED: It shall be unlawful to hunt or take wildlife with a killing device at any time within 150 yards of a residence or building devoted to human occupancy without first obtaining written permission from the owner or occupant.

EXCEPTIONS:

1. Hunting with archery tackle only - 50-yard restriction is applicable.

2. Persons engaged in lawful action for personal safety or to protect their livestock or property.

3. Law enforcement officers and Commission employees in performance of their official job duties.

4. Hunting on any wildlife management area or wildlife demonstration area.

PENALTY: $100.00 to $1,000.00

Opening day for modern gun deer season for the year 2004 will be November 13th.

*Opening day for muzzleloader deer season for the year 2004 will be October 16th.

*These dates are tentative and may be changed by the Commission due to emergencies.

Waterfowl: Guiding is prohibited on all commission-owned or controlled WMAs, WDAs and WRAs.

Choctaw Island WMA (02.14,20.34,21.01,23.05,24.02,24.03,24.04)

Bear, deer, elk, turkey: Closed.

Quail: November 1, 2002-February 8, 2003. Statewide limit applies. Bird dogs allowed.

Rabbit: September 7, 2002-Feburary 28, 2002. Statewide limit applies. Dogs allowed.

Squirrel: September 7, 2002-February 28, 2003. Statewide limit applies. Dogs allowed. May 10-June 12, 2003. Statewide limit applies. No dogs.

Coyote: September 1, 2002-March 1, 2003 and May 15-June 13, 2003. No limit. No dogs.

Furbearer (hunt): Sunrise, September 1, 2002-sunset, February 28, 2003. Limit two per day per species. Raccoons may be taken at night July 1 - November 14, 2002 using .22 short ammunition. Limit one daily. Raccoons may be taken day or night November 15, 2002 - March 31, 2003. No limit. Dogs are required for night hunting during raccoon season.

Furbearer (trap): Sunrise, November 15, 2002 - Sunset, February 9, 2003. No limit.

Muskrat, nutria, and beaver (trap): Sunrise, November 15, 2002-Sunset, March 31, 2003. No limit.

Crow: September 7, 2002-February 28, 2003. Thursday through Monday only. No limit.

02.14 BEAR HUNTING SEASON. It shall be unlawful to take, attempt to take, or possess bear other than during the open season in areas as specified herein:

Archery/Crossbow:

October 1-November 30, 2002 in Bear Zones 1, 2 and Beaver Lake WMA, Bell Sough WMA, Big Creek Natural Area WMA, Big Timber WMA (only on that part of the area that lies in zone 2), Blue Mountain WMA, Buffalo National River WMA, Camp Robinson WD A, Camp Robinson WMA, Caney Creek WMA, Cherokee WMA, Devil's Knob Natural Area WMA, Gene Rush WMA, Greers Ferry Lake WMA, Gulf Mountain WMA, Harold E. 25.02 HUNTING OR TRESSPASSING PROHIBITED WITHIN CERTAIN WMAS, WDAS AND LAKES. It shall be unlawful to duck hunt or trespass on the following areas and lakes as specified herein:

(1) BAYOU METO - Wrape Plantation WRA is open until 12:00 noon for waterfowl hunting on Saturdays and Sundays only during the waterfowl season although opens to hunting all day the last three days of the last duck season. Halowell WRA is closed to access 30 days before the first duck season until February 15.

(2) BELL SLOUGH - Palarm Creek Waterfowl Rest Areas closes to access 30 days before the first duck season until 30 days after the last duck season.

(3) BIG LAKE - Mallard Lake is closed to hunting

(4) BOIS D'ARC - Red Slough Waterfowl Rest Area is open until 12:00 noon for waterfowl hunting on Saturdays and Sundays only during the waterfowl season although hunting is allowed all day the last three days of the last duck season, open to archery deer hunting October 1-31 and open to small game hunting until October 15. Bois d'Arc Lake is closed to waterfowl hunting except open to hunting all day the last three days of the last duck season. Boat motors larger than 25hp are prohibited on the Greentree Waterfowl Area, Red Slough and Little Grassy duck area.

(5) BREWER LAKE - Closed to waterfowl hunting.

(6) CAMP ROBINSON WDA - Closed to waterfowl hunting.

(7) CAMP ROBINSON WMA - Waterfowl hunting ends at noon although hunting is allowed all day the last three days of the last duck season. Duck blinds are prohibited.

(8) CASEY JONES - Waterfowl hunting ends at noon although hunting is allowed all day the last three days of the last duck season.

(9) CUT-OFF CREEK - Pigeon Creek Waterfowl Rest Area closes following the last day of the modern gun deer season until the end of the last duck season. Travel by boat is prohibited on Latin Drain, Firehunt Slough and Third Slough except during high water periods when boating access is possible to the Deep Slough Dam. In this case, boats may be used areawide, however, boat motors may only be used on Cut-Off Creek and Deep Slough.

(10) DAGMAR - Apple Lake Waterfowl Rest Area is open until 12:00 noon for waterfowl hunting on Saturdays and Sundays only during the waterfowl season although hunting is allowed all day the last three days of the last duck season.

(11) DARDANELLE - Waterfowl hunting is not allowed on that part of Big Spadra and Little Spadra Creeks lying north of the Missouri Pacific Railroad, east of Crawford Street, south of 1-40, and west of State Hwy 103 or all park boundaries, state highways and all waterfowl rest areas. Dogs, hunting or trapping devices are prohibited on Johnson County Waterfowl Rest Area and Horsehead Creek and Carbon City WRAs. The WRA closes to access during waterfowl seasons although it is open for archery deer hunting October 1-31 and February 1-28.

(12) DAVE DONALDSON/BLACK RIVER - The GTR Waterfowl Rest Area (all of Section 21, Township 11N, Range 3E lying south of Black River) is open until 12:00 noon for waterfowl hunting on Saturdays and Sundays only during the waterfowl season although opens to hunting all day the last three days of the last duck season. Hunting is not allowed on Hubble Lake during duck season. The rest area and Hubble Lake open to hunting all day the last three days of the last duck season. Lake Ashbaugh is closed to hunting.

(13) ED GORDON/POINT REMOVE - The Waterfowl Rest Area is closed to all hunting and trespassing from November 15 - February 28.

(14) FT. CHAFFEE - The Ft. Chaffee Waterfowl Rest Area in Sportsmen Compartment 3 closes to access 30 days prior to the first duck season until the last duck season closes.

(15) HARRIS BRAKE - Open to waterfowl hunting only Tuesday, Thursday, Saturday and Sunday. Hunting ends at noon although hunting all day is allowed the last three days of the last duck season. During duck season, other hunters must abide by same hours and days as duck hunters, except for those trapping and hunting furbearers at night. Only shotguns and archery equipment are allowed for hunting. Harris Brake Lake is closed to hunting.

(16) HOLLAND BOTTOMS - Lake Pickthorne Waterfowl Rest Area is closed to hunting and it closes to access 30 days prior to the first duck season until 30 days after the last duck season.

(17) LAFAYETTE COUNTY - Waterfowl hunting ends at noon on Lake Erling although hunting is allowed all day the last three days of the last duck season. Waterfowl hunting is not allowed on Lick Creek area of Lake Erling (portion of lake lying west of IP road #41) except for hunting all day the last three days of last duck season.

(18) LITTLE BAYOU - Closed to waterfowl hunting.

(19) NIMROD - Nimrod Waterfowl Rest Area is closed to waterfowl hunting except during the last three days of the last duck season.

(20) PETIT JEAN RIVER WMA - Waterfowl impoundments are closed to trespass from one hour after sunset until 4:00 a.m.

(21) RICK EVANS/GRANDVIEW PRAIRIE - Waterfowl hunting closed on all lakes and ponds.

(22) SHIREY BAY/RAINEY BRAKE - The waterfowl rest area in Sections 7 and 8, T13N, R2W; Sections 21 and 28, T16N, R2W; Section 3, T15N, R2W; and Section 32, T16N, R2W closes to hunting 14 days prior to and during duck season although opens to hunting all day the last three days of the last duck season. .

(23) ST. FRANCIS NATIONAL FOREST - Waterfowl hunting ends at noon. Boat motors over 10 hp are prohibited.

(24) ST. FRANCIS SUNKEN LANDS - Waterfowl hunting ends at noon although hunting is allowed all day the last three days of the last duck season. The Sections 8,9,16 and 17, TUN, R6E is closed to hunting 30 days prior to and during duck season. Rest areas open to hunting all day the last three days of the last duck season.

(25) SULPHUR RIVER - Henry Moore Waterfowl Rest Area closes to access September 1 - February 28, but opens to hunting all day the last three days of the last duck season and to archery deer season October 1-31.

(26) LAKE CONWAY - Closed to waterfowl hunting, except on the Pierce Creek and Dixs Creek Bays. Waterfowl hunting ends at noon.

(27) CANE CREEK LAKE (Lincoln County) - Waterfowl hunting ends at noon.

(28) U OF A PINE TREE EXPERIMENTAL STATION WDA: North of Hwy. 306 closed to all trespassing during waterfowl season.

(29) Lake Pickthorne - Closed to waterfowl hunting.

PENALTY: $200.00 to $1,000.00.

25.07 SHOT SHELL AND SHOT SIZE RESTRICTIONS WHILE WATERFOWL HUNTING ON BAYOU METO, PETIT JEAN RIVER AND NIMROD WMAS. It shall be unlawful to possess more than 15 shot shells per hunter or to possess shot shells containing shot larger than #2 while waterfowl hunting on Bayou Meto, Petit Jean River and Nimrod WMAs

EXCEPTION:

(1) In camping, parking or boat launching areas.

PENALTY: $100.00 to $1,000.00.

25.09 GUIDING PROHIBITED ON ALL COMMISSION OWNED OR CONTROLLED WMAs, WD As, AND WRAs. It shall be unlawful to guide waterfowl hunters on any commission-owned or controlled wildlife management areas, wildlife demonstration areas, or waterfowl rest areas. It shall also be unlawful for waterfowl hunters to hunt while being guided on any commission-owned or controlled wildlife management areas, wildlife demonstration areas, or waterfowl rest areas.

PENALTY: $100.00 TO $1,000.00
