RULE 11.1A Applications by Certain Motor Carriers of Property for Permit to Operate Intrastate.

(a) No motor carrier of property, except those exempt pursuant to Ark. Code Ann. § 23-13-206, shall operate over the highways of Arkansas While transporting property for hire, intrastate, without possessing a copy of an annual receipt from the Arkansas State Highway (Commission permitting such operations. This annual receipt must be copied and a copy must be maintained in each vehicle operated over the highways of Arkansas while transporting property for hire, intrastate. Every application for a permit for the transportation of property, with the exception of applications for the transportation of household goods, shall be in writing on the specified form. Such application shall contain and be accompanied by the following:
(1) The name and trade name (if any), and address or location of the principal office or place of business of applicant;

(2) A statement giving full information concerning the ownership, reasonable value, and physical condition of vehicles and other property to be used by applicant in the operations;

(3) A full and complete financial statement giving detailed information concerning the financial condition of the applicant;

(4) Proof of public liability insurance in the amounts set out in

(5) Remittance of a processing fee in the amount of $25.00;

(6) Remittance of an insurance filing fee in the amount of $5.00 for each vehicle to be operated in the State of Arkansas in intrastate operations;

(7) Remittance of a copy of the motor carrier's Department of Transportation (DOT) safety rating or a signed notarized statement indicating the company's intention to comply with all DOT safety regulations. At such time as may be practical.

a physical inspection of the equipment may be made by the Arkansas Highway Police; and

(8) At the option of the applicant, the motor carrier may request that any and all laws, regulations or other provisions relating to (i) uniform cargo liability rules; (ii) uniform bills of lading or receipts for property being transported; (iii) uniform cargo credit rules; or (iv) antitrust immunity for joint line rates or routes, classification and mileage guides, apply to such carrier.

(b) The transportation of household goods shall continue to be regulated in accordance with the laws of this state and the rules and regulations of this Commission.

(c) Nothing contained herein shall abrogate the authority of the State of Arkansas or the Arkansas State Highway Commission with regard to the routing of hazardous materials.

RULE 11.1B Necessity Of Maintenance Of Receipt By Certain Motor Carriers Of Property To Operate Intrastate.

Each motor carrier of property complying with the provisions of Rule ILIA, above, shall be issued a receipt indicating the name of the company, the principal place of business, and the number of vehicles to be operated in the State of Arkansas. This receipt must be copied and a copy must be maintained in each vehicle operated over the highways of Arkansas while transporting property for hire, intrastate.

RULE 11.1C Conversion of Permits and Annual Fees

(a) Any motor carrier of property, except household goods carriers and those exempt pursuant to Ark. Code Ann. § 23-13-206, holding a certificate or permit authorizing intrastate transportation by motor vehicle issued prior to December 31, 1994, shall be automatically authorized to operate under this program and shall be issued a receipt after complying with the provisions of Rules 11.1 A (a) (4), (6), and (8).

(b) From each for-hire motor carrier of property, an annual fee shall be collected for the registration of insurance. The annual registration fee shall be five (S5.00) dollars for each truck or truck-trailer operated over the highways of the State of Arkansas. Following the payment of such annual registration, the motor carrier shall be issued an annual receipt.

RULE 16.1A Fares For I ntrastate Passengers By Bus

Nothing contained in these rules or regulations is intended to regulate intrastate fares for the transportation of passengers by bus by an interstate motor carrier of passengers over any routes authorized by the Interstate Commerce Commission.
