Section R9-10-517 - Behavioral Care

A. An administrator shall ensure that:
1. A resident who receives
behavioral care from the ICF/IID is evaluated by a behavioral health
professional or medical practitioner:
a.
Within 30 calendar days before the resident is admitted to the ICF/IID or
before the resident begins receiving behavioral care, and
b. At least once every six months throughout
the duration of the resident's need for behavioral care;
2. A behavioral health professional or
medical practitioner:
a. Documents that the
behavioral care needed by the resident is within the ICF/IID's scope of
services, and
b. Includes
measurable objectives for the behavioral care and the methods for meeting the
objectives in the resident's individual program plan; and
3. The documentation in subsection (A)(2) is
included in the resident's medical record.
B. If a resident of an ICF/IID requires behavioral health services provided by a behavioral health professional on an intermittent basis as part of behavioral care, an administrator shall ensure that:
1. The behavioral health services are
provided by a behavioral health professional licensed or certified to provide
the type of behavioral health services required by the resident; and
2. Except for a psychotropic drug used as a
chemical restraint or administered according to an order from a court of
competent jurisdiction, informed consent is obtained from a resident or the
resident's representative for a psychotropic drug and documented in the
resident's medical record before the psychotropic drug is administered to the
resident.
