Section R18-9-A305 - Facility Expansion

A. A permittee may expand a facility covered by a Type 2 General Permit if, before the expansion, the permittee provides the Department with the following information by certified mail:
1. An updated
Notice of Intent to Discharge,
2. A
certification signed by the facility owner stating that the expansion continues
to meet all the conditions of the applicable general permit, and
3. The applicable fee established under 18
A.A.C. 14.
B. A permittee may expand a facility covered by a Type 3 or Type 4 General Permit if the permittee submits a new Notice of Intent to Discharge and the Department issues a new Discharge Authorization.
1. The
person submitting the Notice of Intent to Discharge for the expansion may
reference the previous Notice of Intent to Discharge if the previous
information is identical, but shall provide full and detailed information for
any changed items.
2. The Notice of
Intent to Discharge shall include:
a. Any
applicable fee established under 18 A.A.C. 14, and
b. A certification signed by the facility
owner stating that the expansion continues to meet all of the requirements
relating to the applicable general permit.
3. Upon receiving the Notice of Intent to
Discharge, the Department shall follow the applicable review and authorization
procedures described in
R18-9-A301(A)(3)
or (4).
