Section R12-15-1201 - Applicability

A. This Article applies to any artificial barrier meeting the specifications of A.R.S. § 45-1201(1) as interpreted by R12-15-1204. This Article applies to an application for the construction of a dam and reservoir; an application to reconstruct, repair, alter, enlarge, breach, or remove an existing dam and reservoir, including a breached or damaged dam; operation and maintenance of an existing dam and reservoir; and enforcement. A structure identified in R12-15-1203 is exempt from this Article.
B. This Article is applicable to any dam regardless of hazard potential classification, with the following exceptions:

R12-15-1208,
R12-15-1209,
R12-15-1213,
R12-15-1221,
R12-15-1225, and R12-15-1226 apply only to a dam classified as a high or
significant hazard potential dam.
2.
R12-15-1210
applies only to a dam classified as a low hazard potential dam. A low hazard
potential dam is exempt from
R12-15-1208,
R12-15-1209,
R12-15-1211,
R12-15-1213,
R12-15-1221,
R12-15-1225, and R12-15-1226.
3.
R12-15-1211 applies only to a dam classified as a very low hazard potential
dam. A very low hazard potential dam is exempt from
R12-15-1208,
R12-15-1209,
R12-15-1210, R12-15-1212, R12-15-1213, R12-15-1215, R12-15-1216, R12-15-1221,
R12-15-1225, and R12-15-1226.
4.
R12-15-1216(B) applies only to an embankment dam.
