(a) To be eligible for Medicaid under 7 AAC 100.002(b) (8) and this subsection, the applicant must verify to the department that the applicant was or would have been eligible for OAA, AB, or APTD in August 1972.

(b) To be eligible for Medicaid under 7 AAC 100.002(b) (9) and this subsection, the applicant must verify to the department that the applicant

(1) was eligible for Medicaid in December 1973; and

(2) is currently residing in and has continuously resided in a medical institution since December 1973.

(c) To be eligible for Medicaid under 7 AAC 100.002(b) (10) and this subsection, the applicant must verify to the department that the applicant

(1) was eligible for Medicaid in December 1973 as a blind or disabled individual, regardless of whether the individual received cash assistance in December 1973;

(2) for each consecutive month since December 1973, continued to meet the December 1973 criteria for blindness or disability and all other conditions of eligibility used under the Medicaid plan on that date; and

(3) qualifies for Medicaid under this chapter, except for requirement of a determination of blindness or disability required under 7 AAC 100.400.

(d) To be eligible for Medicaid under 7 AAC 100.002(b) (11) and this subsection, the applicant must verify to the department that the applicant is entitled to receive a mandatory state supplement based upon the applicant's receipt of cash payment from the state's OAA, AB, or APTD program in December 1973.

(e) To be eligible for Medicaid under 7 AAC 100.002(b) (12) and this subsection, a child under 18 years of age must verify to the department that

(1) the child was receiving SSI on August 22, 1996; and

(2) the only reason the child lost SSI eligibility was because of the amendment to the definition in 42 U.S.C. 1382 c(a)(3) of "childhood disability" by sec. 201(a), P.L. 104-193 (Personal Responsibility and Work Opportunity Reconciliation Act of 1996).
