7 AAC 100.252 - Under-21 individual living with a parent, spouse, or independently

(a) The eligibility categories identified in 7 AAC 100.002(c) (2) - (4) include an individual under 21 years of age who is

(1) living with one or both parents;

(2) married and living with the individual's spouse;

(3) living independently of parent or spouse as determined under (c) of this section; or

(4) a minor living independently of the individual's parents but who is in the care of a responsible adult or agency.

(b) The Family Medicaid adult-included standards set out in 7 AAC 100.190(a) (1) will be used to determine income eligibility for an individual identified in (a)(1), (2), or (3) of this section. The Family Medicaid adult-not-included, child-only standards set out in 7 AAC 100.190(a) (2) will be used to determine income eligibility for an individual identified in (a)(4) of this section.

(c) For the purpose of determining financial eligibility for an individual under (a)(3) of this section, the department will consider an individual to be living independently beginning on the first day the individual is not living in the home of that individual's parent or spouse and that individual

(1) has not lived in the home of the individual's parent or spouse for at least 30 consecutive days;

(2) left home to attend an educational, training, or treatment institution or program that involves a residential living arrangement, including the National Guard Youth Corps;

(3) left home to enter a medical institution or treatment facility in the state that involves a residential living arrangement and that treatment has lasted 30 consecutive days or longer; an individual may be transferred from one medical institution or treatment facility directly to another without interrupting the 30-consecutive-day period; or

(4) left home to enter an out-of-state medical institution or treatment facility that involves a residential living arrangement and the department gives prior authorization under 7 AAC 105 - 7 AAC 160 to a continuous 30-day placement in that facility.
