(a) Except as provided in (b) of this section, a child support payment made in cash is income for the purpose of determining eligibility for Family Medicaid when that child support payment is actually received.

(b) Of a child support payment that is received by the applicant or recipient directly from the parent, $50 is exempt income. If an applicant or recipient keeps more than $50 of the total amount of direct child support payments received in one month, the amount in excess of $50 will be considered unearned income.

(c) A child support payment made by any means other than cash will not be considered income under this section.

(d) A child support payment will be considered income under this section whether the payment is made voluntarily or involuntarily.
