7 AAC 100.120 - Inclusions and exclusions from the Family Medicaid eligibility determination

(a) The financial needs, income, or resources of the following individuals are not included in a Family Medicaid eligibility determination even if the individual is living in the same home as a dependent child:
(1) a recipient of SSI or
APA;
(2) the sibling of a dependent
child if the sibling does not meet the Family Medicaid age or deprivation
requirements;
(3) a stepparent and
the stepparent's own children, if including them in an existing household would
cause another child in the home who is deprived by reason of death or continued
absence of a parent to lose eligibility if the stepparent's income and
resources were counted;
(4) an
alien who is not eligible for Medicaid and who is not the dependent child's
natural or adoptive parent;
(5) an
individual for whom state or Title IV-E foster care maintenance payments are
being paid;
(6) a sibling of a
dependent child whose inclusion in the household would cause the dependent
child to lose financial eligibility if the sibling's income were deemed
available to the dependent child;
(7) the parent of a child 18 years of age or
older if
(A) the child is in her third
trimester of pregnancy; and
(B) the
parent has no other dependent children in the household.
(b) Any of the following individuals living in the same home as a dependent child is included in the Family Medicaid household, and the individual's financial needs, resources, and income count for the purposes of determining Family Medicaid eligibility for the household, but the individual is not entitled to receive Family Medicaid benefits:
(1) the parent of a dependent
child, if the parent is ineligible for failure to
(A) cooperate under
7 AAC 100.042 with the child support services agency;
or
(B) comply with the verification
and documentation requirements of
7 AAC 100.016;
(2) the parent of a dependent child, if the
parent is ineligible because of income deemed from a spouse who is only a
stepparent to the dependent child;
(3) the parent or sibling of a dependent
child, if the parent or sibling is ineligible for Family Medicaid because the
parent or sibling is
(A) a qualified alien
subject to the five-year bar under
7 AAC 100.056; or
(B) an alien who is not a qualified alien
under 7 AAC 100.052.
