(a) A Family Medicaid household may not include a child or adult who is receiving SSI, APA, or foster care maintenance payments. The department will disregard the financial needs, income, and resources of a child or adult receiving SSI, APA, or foster care payments when determining the applicable Family Medicaid need standard based upon household size under 7 AAC 100.190.
(b) An adult identified in (a) of this section may be the only member in a Family Medicaid household if that adult is the
(1) caretaker relative of a child
receiving SSI; or
(2) foster parent
of a dependent child who is receiving state or Title IV-E foster care
maintenance payments.
