7 AAC 100.114 - Family Medicaid household combinations

(a) A Family Medicaid household may include any of the following:

(1) one adult and any number of dependent children for whom the adult is a caretaker relative;

(2) only a dependent child or children if the caretaker relative is not included in the Medicaid household for the purpose of determining Medicaid eligibility;

(3) only a caretaker relative and no child if the caretaker relative is
(A) a pregnant woman in her last trimester eligible under 7 AAC 100.124;

(B) a caretaker relative of a child receiving SSI; or

(C) caring for a child on whose behalf the caretaker relative is receiving foster care maintenance payments;

(4) two parents and any number of dependent children, if the household meets the requirements of deprivation by deficient employment under 7 AAC 100.106(c).

(b) If a child living in a two-parent household is deprived of parental support and care because of deficient employment under 7 AAC 100.106(c), both parents must be included in the household and have their income and resources counted, unless one parent is ineligible for another reason.

(c) Except as provided in (a)(4) of this section, a Family Medicaid household may not include more than one caretaker relative, even if other individuals who meet the definition of a caretaker relative are living in the dependent child's home.

(d) The department will not include a child in a household for any part of a month in which that child received Family Medicaid as a recipient of Title IV-E foster care payments.

(e) The department will include a stepparent in the household only if the

(1) stepparent is the natural or adoptive parent of at least one child in the household;

(2) parent and the stepparent have a common child living in the home; or

(3) stepparent is the caretaker relative when the other parent is not included in the household because the other parent is
(A) absent from the home; or

(B) an SSI or APA recipient.
