7 AAC 100.710 - Breast and cervical cancer group

(a) To be eligible under 7 AAC 100.002(d) (7), a woman must

(1) at the time of application, have been screened through the department's Breast and Cervical Health Check program or through a similar program from another state that is part of the United States Department of Health and Human Services, Centers for Disease Control and Prevention National Breast and Cervical Cancer Early Detection program;

(2) as a result of the screening under (1) of this subsection, have been determined to need treatment for breast, cervical, or directly related cancer;

(3) be a resident of the state under 7 AAC 100.060;

(4) comply with the assignment of rights requirements of 7 AAC 100.034;

(5) comply with the requirements of 7 AAC 100.050;

(6) be ineligible under all other Medicaid eligibility categories;

(7) be under 65 years of age; and

(8) have no creditable coverage for treatment of breast or cervical cancer.

(b) A woman who is eligible for Medicaid under this section remains eligible during the period that the woman is receiving treatment for breast, cervical, or directly related cancer and meets the requirements of (a) of this section. A woman is presumed to be receiving treatment for the duration of the period in the treatment plan established by the treating health care professional. The department will review annually each recipient's eligibility under this subsection. If, during an ongoing period of eligibility, a metastasized cancer is found in another part of the woman's body that is a known or presumed complication of the breast, cervical, or directly related cancer, the woman's Medicaid eligibility will be extended to cover treatment of that cancer. If additional breast, cervical, or directly related cancer is found after a treatment period has ended and Medicaid eligibility has terminated, a woman must be recertified as eligible for the screening program described in (a)(1) of this section before Medicaid eligibility can be reestablished.

(c) A woman who is eligible under this section is eligible for all Medicaid covered services as determined under 7 AAC 105 - 7 AAC 160.

(d) In this section, "creditable coverage" has the meaning given in 42 U.S.C. 1396 a(aa)(4), except that "creditable coverage" includes coverage for the type of cancer for which the beneficiary needs treatment.
