7 AAC 100.070 - Continuous eligibility for children

(a) Except as provided in (b) and (c) of this section, a child under 19 years of age who is eligible for Medicaid remains eligible for Medicaid for a continuous 12-calendar-month period beginning with the month a prospective eligibility determination is made. Each time a new prospective eligibility determination is made a new 12-calendar-month period begins. During a continuous eligibility period a child continues to be eligible regardless of changes in income, resources, family status, or household composition.

(b) The 12-calendar-month continuous eligibility period provided in this section is not available to a child who is eligible for Medicaid under

(1) any of the following eligibility categories:
(A) newborns under 7 AAC 100.002(a) (5);

(B) children in the eligibility category described in 7 AAC 100.002(a) (3);

(C) children in the eligibility category described in 7 AAC 100.002(a) (2) (Transitional Medicaid); or

(2) retroactive Medicaid described in 7 AAC 100.072.

(c) A continuous period of eligibility ends at the earliest of

(1) the end of the 12th month of continuous eligibility;

(2) the end of the first month the child reaches 19 years of age;

(3) the end of the month the child is detained in a juvenile facility or correctional facility, except as described in 7 AAC 100.068;

(4) the death of the child;

(5) closure of a case due to loss of contact with the applicant or recipient;

(6) the date the child loses residency in this state; or

(7) the date the previous eligibility period is replaced by a new 12-calendar-month continuous eligibility period that is the result of a new prospective eligibility determination.

(d) The continuous eligibility period provided in this section protects a child's eligibility for a maximum of 12 months from the month of the last prospective eligibility determination.

(e) In this section, "prospective eligibility determination" means a new categorical and financial eligibility determination that results in the establishment of a new future date on which a review application will be required under 7 AAC 100.020.
