7 AAC 54.400 - Method of public disclosure

(a) The division shall make disclosable information available to the public, upon written or verbal request, by using a disclosure record form provided by the department.

(b) Information may be transmitted by telephone, mail, facsimile, or other electronic means as may be most expedient under the circumstances.

(c) Except as provided in (d) of this section, the division shall try to provide an immediate response to a public request for information, and, in any case, shall respond no later than five business days after a request for information is received.

(d) The division may delay disclosure to the public under AS 47.12.315 if the department is in the process of petitioning the court to prohibit disclosure of information under AS 47.12.315(f) on the basis that the offense is an isolated incident and the juvenile does not present any further danger to the public. Decisions on whether to petition the court to prohibit disclosure must be made within 30 days after the department receives a police investigation report for an offense specified in AS 47.12.315.
