Alaska Administrative Code
Title 7 - Health and Social Services
Part 3 - Public Assistance and Medical Assistance
Chapter 47 - General Relief
Article 3 - Senior Benefits Program
7 AAC 47.570 - Adjustment of assistance
Current through August 30, 2024
(a) If appropriations for assistance under AS 47.45.301-47.45.309 and 7 AAC 47.547 - 7 AAC 47.599 are insufficient to meet the demands for that assistance in a fiscal year, the department will take the following actions to reduce or eliminate the cash assistance benefit available to a recipient for that fiscal year:
(b) If the department reduces benefits under (a)(3) of this section, the department may close the program to new applicants for a time period not longer than the end of the current fiscal year to prevent additional benefit reductions to individuals whose household income does not exceed 75 percent of the annual federal poverty line described in AS 47.45.302(a)(4).
(c) Before making any benefit reductions under (a) of this section, the department will notify all individuals currently receiving benefits under AS 47.45.301-47.45.309 and 7 AAC 47.547 - 7 AAC 47.599 of the amount of the reduction.
Section 1, ch. 11, SLA 2016 renumbered former AS 47.45.302(a)(3) as AS 47.45.302(a)(4), without amending the substance of that provision. As of Register 219 (October 2016), the regulations attorney made conforming technical revisions under AS 44.62.125(b)(6), to 7 AAC 47.570 so that cross-references to former AS 47.45.302(a)(3) now refer to the renumbered paragraph, AS 47.45.302(a)(4).
