7 AAC 47.440 - Assisted living home agreement for services

(a) An assisted living home must submit an application for an assisted living home agreement in a format provided by the department.

(b) An assisted living home agreement for services between the department and an assisted living home must

(1) include the appropriate minimum daily reimbursement rate under 7 AAC 47.470 or 7 AAC 47.471; and

(2) incorporate each resident's residential service contract executed under AS 47.33.210 and assisted living plan prepared under AS 47.33.220 and 47.33.230 by reference; the contract and plan must describe the services the assisted living home must provide to the individual in accordance with AS 47.24, AS 47.33, 7 AAC 47.475, and 7 AAC 75.

(c) Before an assisted living home admits an individual, the assisted living home shall

(1) obtain and review a copy of the individual's general relief assisted living home care application under 7 AAC 47.390 and any pertinent documentation related to the individual's health, safety, and welfare needs; and

(2) provide an assurance to the department that the assisted living home can meet the individual's health, safety, and welfare needs.

(d) An assisted living home shall

(1) comply with the standard as set out under 7 AAC 47.450(d);

(2) immediately report the occurrence of an incident as set out under 7 AAC 75.340 to the department, in a format provided by the department; and

(3) report any absence or discharge required to be reported as set out under 7 AAC 47.490 to the department.

(e) An assisted living home agreement may be terminated by either party upon 30 days' advance written notice to the other party.

(f) The department may immediately terminate an assisted living home agreement if

(1) the assisted living home fails to comply with the requirements of this section or 7 AAC 47.300 - 7 AAC 47.535; or

(2) the assisted living home's license is suspended or revoked, or the assisted living home is not licensed under AS 47.33 or 7 AAC 75.

As of Register 218 (July 2016), the regulations attorney made a technical correction under AS 44.62.125(b)(6), to 7 AAC 47.440(d) (now 7 AAC 47.440(f)).
