7 AAC 45.335 - ATAP assistance unit

(a) An ATAP assistance unit consists of those individuals whose needs are considered in determining eligibility for assistance and the amount of the ATAP payments. An assistance unit may include

(1) a caretaker relative and any number of dependent children with an eligible relationship to the caretaker relative;

(2) dependent children with an eligible relationship to the caretaker relative;

(3) one caretaker relative and no child if the caretaker relative is a pregnant woman eligible for ATAP benefits under 7 AAC 45.510; or

(4) two parents and any number of dependent children.

(b) Except as provided in (a)(4) of this section, an assistance unit may not include more than one caretaker relative, even if there are other potentially eligible caretaker relatives in the dependent child's home.

(c) A caretaker relative may refuse all or part of ATAP benefits or other benefits related to ATAP, that an individual in the assistance unit is eligible to receive.

(d) The department will not include a child in an assistance unit for any part of a month in which that child received Title IV-E Foster Care payments.

(e) The following individuals are not eligible for ATAP benefits and will not be included in the assistance unit:

(1) except as provided in 7 AAC 45.515, an individual who is receiving SSI or APA benefits;

(2) an individual who is ineligible under 7 AAC 45.215 because the individual is not a national or citizen of the United States or an alien in eligible immigration status;

(3) an alien who is ineligible under 7 AAC 45.215(d) because the alien is sponsored by an agency or organization;

(4) an alien who is ineligible under 7 AAC 45.290 or 7 AAC 45.325 due to availability of a sponsor's resources or income;

(5) repealed 10/1/2001;

(6) a stepparent who is not the parent of at least one child in the assistance unit;

(7) an individual who is ineligible due to participation in a strike, in accordance with 7 AAC 45.265.

(f) Repealed 7/1/97.
