Universal Citation: 7 AK Admin Code 7 AAC 45.266

Current through February 27, 2024

(a) If the department determines that a lump-sum diversion payment under AS 47.27.026 would be appropriate to meet the needs of the family of an adult applicant for ATAP benefits under AS 47.27.020, the department may offer to the applicant the option between

(1) the lump-sum diversion payment; and

(2) ongoing ATAP benefits.

(b) Based on information provided in the ATAP application and other information or documentation that the department requires, the department will consider the following factors in deciding whether to offer an applicant the diversion-payment option:

(1) the job readiness of the applicant;

(2) the family's critical financial needs in order to secure employment or family support, including shelter, child care, vehicle, and work-related costs;

(3) other resources available to the family, apart from a lump-sum diversion payment, to meet the identified needs.

(c) A recipient of a diversion payment is not an ATAP benefits recipient, and is not required to develop a family self-sufficiency plan under AS 47.27.030 nor to participate in work activities under AS 47.27.035.

(d) A diversion payment does not count as an ATAP payment when calculating the total number of months of ATAP eligibility under AS 47.27.015(a)(1).

(e) The department may make a diversion payment to an applicant directly, by means of check, money order, or electronic funds transfer, or indirectly, by means of payment to a vendor, landlord, or employer, or other person, as determined by the department to be most efficient in accomplishing the purposes of AS 47.27.

(f) For the purposes of AS 47.27.026, "job ready" means currently working or having prospects for employments within 30 days.
