7 AAC 45.265 - Denial of benefits to strikers

(a) An assistance unit is ineligible for ATAP benefits for any month in which a parent with whom the dependent child is living is participating in a strike on the last day of that month.

(b) If an individual who is part of an assistance unit, but is not a parent, is participating in a strike on the last day of a month, the following is not included in the ATAP eligibility determination and payment calculation for the assistance unit for that month:

(1) the financial or medical needs of the individual on strike; and

(2) the income and resources of the individual on strike.

(c) In this section,

(1) "strike" means a strike or the concerted stoppage of work by two or more employees, including a stoppage because of expiration of a collective bargaining agreement, and any concerted slowdown or other concerted interruption of operations by employees;

(2) "participating in a strike" means, in concert with others, an actual refusal to provide services to one's employer.
