7 AAC 13.030 - Governing boards and advisory boards

(a) To be eligible to receive financial assistance under AS 18.25.070-18.25.110, a facility must be either governed or advised by a board selected in accordance with the following criteria:

(1) A governing or advisory board must be composed of at least five members who reside in the area served by the facility.

(2) A majority of board members may not have been health care providers for the 12 months before appointment. No more than two members, or 40% of the membership, whichever is greater, may be health care providers.

(3) To the extent practicable, a governing or advisory board must be representative of the geographic service area, including representatives of the
(A) major racial and linguistic groups; and

(B) various economic groups.

(4) A representative of a particular subgroup or class of members need not be an actual member of the subgroup or class if the representative is designated by an organization composed primarily of members of the subgroup or class.

(5) No employee of a grantee; or spouse, parent or child of an employee of a grantee; may be a member of the grantee's governing board.

(6) If the facility is to serve two or more communities, each participating community must be represented on the governing or advisory board by members appointed by the city council, the Indian Reorganization Act (IRA) council, or the traditional council.

(b) An advisory board shall participate in program planning, development, and evaluation, and shall advise the governing board on policy, administration procedures, and other areas of primary health care.

(c) A governing board shall approve selection of the facility's program directors, mid-level practitioners, or subcontractors. If the governing board does not meet the criteria of (a) of this section, the facility staff may be selected or discharged only after consultation with an advisory board that does meet those criteria.
