7 AAC 05.560 - Local registrars

Local registrars are authorized, under the conditions set forth herein, to grant an extension of time for the filing of certain certificates and the obtaining of certain permits for events which occurred within their registration district, in cases where it is evident that a hardship would result from strict compliance with the time limit set in the law. This is a privilege which should not be abused; it should not be granted in cases where it has been repeatedly abused. Blanket extensions shall not be given; a separate request must be made in each case. The request may be verbal, in person or by phone, or it may be in writing. In any case the hardship must be fully explained and established. Full identifying particulars must be given concerning the certificate or permit involved, and a statement given as to who will be responsible for filing the certificate or obtaining the permit and when. If the local registrar is satisfied that all conditions have been met and that the required act will be completed as promised, he may grant the following extensions of time:

(1) for filing a certificate of birth, an additional period not to exceed 10 days;

(2) for filing a certificate of death or fetal death, an additional period not to exceed three days if the burial-transit permit has not been issued;

(3) for completing the medical certification of cause of death, an additional period not to exceed three days if the burial-transit permit has not been issued;

(4) for obtaining a burial-transit permit, an additional period not to exceed three days;

(5) he may issue the burial-transit permit prior to the filing of the certificate of death or fetal death, and then grant an additional period of time not to exceed 10 days for both the completing of medical certification and the filing of the certificate; and

(6) he may give verbal permission to move a body within the state prior to filing a death certificate or issuance of a burial-transit permit; provided all other conditions have been fulfilled.
