5 AAC 93.400 - Application for qualified salmon fishery association

(a) The commissioner will determine that an applicant for a qualified salmon fishery association is qualified under AS 16.40.250 if the applicant meets the requirements of this section.

(b) Each year, the commissioner will only accept an application under this section that is submitted to the commissioner either from

(1) April 1 through April 15; or

(2) September 1 through September 15.

(c) An applicant for qualification as a qualified salmon fishery association under this section must submit

(1) a complete application on a form prescribed by the department;

(2) a certified copy of valid articles of incorporation and bylaws or other proof of incorporation as a nonprofit corporation under AS 10.20;

(3) proof that the salmon fishery association is comprised of only interim-use permit and entry permit holders in the salmon fishery for which the association is established; and

(4) a list of the name, address, and telephone number of each member of the board of directors of the association that shows that the members meet the requirements of AS 16.40.250(3).

(d) In this section,

(1) "commissioner" means the commissioner of fish and game;

(2) "department" means the Department of Fish and Game;

(3) "qualified salmon fishery association" has the meaning given in AS 43.76.280.

For the purpose of 5 AAC 93.400, the commissioner of the Department of Fish and Game's address is Commissioner, Department of Fish and Game, Headquarters Office, 1255 W. 8th Street, P.O. Box 115525, Juneau, AK 99811-5525.
