5 AAC 92.046 - Permits for taking incidental or stranded musk oxen

The commissioner may open, by emergency order, a season for which the resident tag is waived and with a bag limit of up to 2 musk oxen per person by permit only in the areas and under the conditions specified below:

(1) in Game Management Unit 24, state managed lands in the Anaktuvuk Pass area within 2 miles of the John River and Unit 26A;

(2) statewide, if the musk oxen are stranded on sea ice or islands and the commissioner determines that the musk oxen have inadequate food and water resources for survival, or that they are doing severe damage to other resources of the island and that all reasonable effort has been made to remove them from the island or sea ice by non-lethal means.

(3) in Game Management Unit 18, if musk oxen are stranded on free-floating ice floes completely surrounded by salt water, a resident may harvest the stranded musk oxen without a permit; the hunter must demonstrate the ice floe conditions by submitting photographic evidence to the Alaska Department of Fish and Game within 48 hours of harvest.

Although the history note for 5 AAC 92.046 reflects an original effective date of 7/1/98, Register 146, the section existed earlier as an emergency regulation. The emergency regulation, which dealt with Permits for Taking Stranded Muskoxen, was in effect for 120 days, from 8/6/97 - 12/3/97, Register 143. Through error, a notation of its 120-day existence was not added to the "permanent" regulations portion of the 5 AAC pamphlet at the time the emergency regulation lapsed and was deleted from the emergency regulations portion of that pamphlet. As a result of that error, the lapsed section number was inadvertently re-used for the current provision numbered as 5 AAC 92.046 and the history note for that section does not reflect the earlier 120-day existence of the emergency regulation.
