22 AAC 20.430 - Parolees eligible for a preliminary revocation hearing

(a) The following parolees have a right to a preliminary revocation hearing under AS 33.16.220 if incarcerated for a parole violation:

(1) any Alaska parolee subject to the jurisdiction of the Alaska Parole Board;

(2) any adult parolee being supervised in this state under AS 33.36.110 (Interstate Compact for Adult Offender Supervision);

(3) any other adult parolee in this state, but not being supervised in this state under AS 33.36.110 (Interstate Compact for Adult Offender Supervision), if the state having parole jurisdiction over the parolee has requested that a hearing be held in this state.

(b) A parolee under the parole jurisdiction of this state, but being supervised in another state under AS 33.36.110 (Interstate Compact for Adult Offender Supervision) has a right to a preliminary revocation hearing in the receiving state if arrested there, subject to the rules of the receiving state. If the parolee is arrested anywhere other than in the receiving state, the preliminary hearing will be conducted at any reasonable location designated by the board.

(c) A preliminary revocation hearing on an Alaska parolee who absconds supervision from the area of supervision will be conducted at any reasonable location designated by the board.

(d) A parolee on parole from a jurisdiction other than Alaska must appear before the originating board for a final revocation hearing.
