22 AAC 05.495 - Time frames for action after administrative segregation hearing

(a) Time periods for action taken following initial and 30-day-review administrative segregation hearings are the same as those set out in 22 AAC 05.212.
(b) A prisoner who is either facing or appealing disciplinary action who has been assigned to administrative segregation and who has been provided a 30-day review hearing under 22 AAC 05.485(d), is entitled to action within the following time frames. Within one working day after the classification hearing, the committee shall prepare a written report of classification action and deliver it to the superintendent. The superintendent shall approve or disapprove the report, or refer the matter back to the committee for further consideration, within two working days after receipt of the report. If the matter is referred back to the committee, the committee has four working days within which to review the matter. The prisoner shall immediately be released from administrative segregation unless the superintendent determines that the prisoner continues to meet the criteria for placement in administrative segregation under 22 AAC 05.485(a).
(c) Following the initial placement in administrative segregation maximum, a review of a prisoner's placement in administrative segregation maximum shall be completed every four months to determine the continued need for this placement.
