15 AAC 125.605 - Criteria for licensing actions

(a) The agency will include on the licensing lists required to be compiled under AS 25.27.244(a) and 25.27.246(a) the name of an obligor
(1) for whom
(A) a valid child support order is in
effect;
(B) if the list is compiled
under AS
25.27.244(a), a payment
schedule is in effect; or
(C) if
the list is compiled under
AS
25.27.246(a), a payment
schedule is in effect for which the obligor paid the monthly obligation for at
least two years immediately after the schedule was negotiated;
(2) who owes an amount that is
more than four times the monthly support obligation under the child support
order or payment schedule; and
(3)
whose arrears exceed $1,000.
(b) The agency may not include on the licensing lists required to be compiled under AS 25.27.244(a) and AS 25.27.246(a) the name of an obligor who would otherwise qualify for licensing action under (a) of this section if any of the following conditions is met:
(1) the obligor has an active bankruptcy
action pending;
(2) the obligor is
currently making payments under an income withholding order issued by the
agency or a payment agreement with the agency;
(3) the obligor is currently receiving
unemployment insurance benefits;
(4) the obligor is deceased; or
(5) the agency is not enforcing the child
support order under which the arrears are owed.
