15 AAC 125.900 - Definitions

(a) Unless the context indicates otherwise, when used in this chapter,

(1) "AFDC" means public assistance granted under the program of Aid to Families with Dependent Children;

(2) "agency" means the Alaska child support services agency;

(3) "application" means a signed request for child support enforcement services;

(4) "child support enforcement services" include, but are not limited to,
(A) location of absent parents;

(B) establishment of support obligations;

(C) enforcement of support obligations;

(D) collection and distribution of child support payments;

(E) establishing paternity;

(F) responding to and initiating actions under the Uniform Interstate Family Support Act (AS 25.25.101-25.25.903);

(5) "periodic payments" means the amount to be paid in regularly scheduled installments in satisfaction of the support obligation; when applicable, it also refers to regularly scheduled payments to satisfy past-due obligations;

(6) "credit bureau" means any person who, for monetary fees, dues, or on a cooperative non-profit basis, regularly engages in whole, or in part, in the practice of assembling or evaluating consumer credit information or other information on consumers for the purpose of furnishing consumer reports to third parties, and who uses any means or facility or interstate commerce for the purpose of preparing or furnishing consumer reports;

(7) "lending institution" means a person who, for monetary fees, dues, or on a cooperative non-profit basis, regularly engages in the business of lending money;

(8) "person" means an individual, partnership, corporation, trust, firm, estate, cooperative, association, organization, government, governmental subdivision, governmental agency, or other entity;

(9) "ATAP" means the Alaska Temporary Assistance Program, codified as AS 47.27.005-47.27.900;

(10) "business day" means a day on which state offices are open for regular business;

(11) "income" means any periodic form of payment due to an individual, regardless of source; the term includes wages, salaries, commissions, bonuses, worker's compensation, disability, payments under a pension or retirement program, and interest;

(12) "parent" means the natural or adoptive parent, a person who has the legal status of the parent as a result of the person's marriage to the child's mother or the legitimation of the child under AS 25.20.050, a legal guardian, or a caretaker relative having custody of or responsibility for the child or children;

(13) "support order" means a judgment, decree, or order, whether temporary, final, or subject to modification, issued by a court or administrative agency of competent jurisdiction for the support and maintenance of a child, including a child who has attained the age of majority under the law of the issuing state, or for the support and maintenance of a child and the parent with whom the child is living; a judgment, decree, or order is a "support order" if it provides for monetary support, health care, arrearages, or reimbursement, and a judgment, decree, or order that is a "support order" may include related costs and fees, interest and penalties, income withholding, attorneys' fees, and other relief;

(14) "tribunal" means a court, administrative agency, or quasi-judicial entity authorized to establish, enforce, or modify support orders or to determine parentage;

(15) "administrative support order" means a support order that the agency establishes under AS 25.27.160;

(16) "director" means the director of the agency;

(17) "direct payment" means a child support payment made by or on behalf of the obligor directly to the custodial parent in the form of cash, a money order, a check made payable to the custodial parent, or a deposit or electronic funds transfer to a bank or equivalent financial account held by the custodial parent;

(18) "domestic violence" has the meaning given in AS 18.66.990;

(19) "in-kind contribution"
(A) means a benefit that is
(i) provided by the obligor;

(ii) received by the custodial parent, the minor child, or a third party on behalf of the custodial parent or minor child;

(iii) intended for the benefit of the minor child; and

(iv) not a direct payment or a payment to the agency; and

(B) includes services, clothing, food, school supplies, other goods, and payments to third parties.

(20) "child support agency of another state" means a child support agency of another state within the meaning given in AS 25.25.101 or a foreign country within the meaning given in AS 25.25.101.

(b) For the purposes of AS 25.27.275, "location" is limited to the information contained in the agency file concerning payment, mailing, or actual address of the children at the time the request for release of location is made to the agency.

As of Register 81 (April 1982), 15 AAC 147.160 has been relocated to 15 AAC 147.900. The history note under 15 AAC 147.900 includes the history of 15 AAC 147.160.

As of Register 171 (October 2004), and acting under AS 44.62.125(b)(6) and sec. 12, ch. 107, SLA 2004, the regulations attorney made technical changes to reflect the name change of the child support enforcement agency to the child support services agency made by sec. 1, ch. 107, SLA 2004.
