(a) During the second or third trimester of a pregnancy, abortions shall be performed under sterile conditions. A bed and a registered nurse shall be available for a minimum recovery period of one-half hour. A registered nurse shall be present during the procedure.

(b) From and after the point in time when a fetus becomes viable, as determined by those medical examinations and tests that in the physicians professional judgement are necessary, an abortion may only be performed at a hospital with a neonantal intensive care unit (NICU).
