11 AAC 91.070 - Nonconforming uses

A nonconforming use or structure that exists at the date zoning or a change in zoning becomes applicable to a specific tract of land may continue so long as there is no modification of the nonconforming use or structure in excess of 15 percent of its value at the date modification is made, and so long as the nonconforming use continues uninterrupted. Any modification of a nonconforming use or structure in excess of 15 percent of its value, or any cessation of the nonconforming use, will terminate the privilege of continuing the nonconforming use or use of the nonconforming structure. However, nothing in this section prevents any modification of a nonconforming use or structure that would serve to reduce its nonconformity.
