11 AAC 83.111 - Rental payments during an appeal or pending application

For a lease that is expired but otherwise remains subject to a pending application or appeal, the lessee must continue to pay annual rental at the previous year's rental rate, on or before the anniversary of the lease, during the application or appeal process. If, upon resolution of an appeal or final decision issued by the department, a lease is not extended, the department may refund the rental for the current lease year, prorated by month and acreage, starting the first day of the month following the time when the appeal resolution or decision becomes final.
